Terms of Service

These Terms of Service ("Terms") govern your use of Upbot, a status monitoring service for Discord communities, operated at upbot.gg ("we", "us", "our"). By using Upbot, you agree to these Terms.

1. Service Description

Upbot monitors the availability of Discord bots, HTTP endpoints, status pages, Roblox game servers, and other online services. Alerts are delivered through Discord channels, email, and webhooks. A web dashboard is provided to manage your monitored services.

2. Account Requirements

• You must be at least 13 years old to use Upbot, consistent with Discord's Terms of Service.
• A Discord account is required to sign up and authenticate.
• You are responsible for maintaining the security of your account and any activity under it.
• You must provide accurate information when creating your account.

3. Subscription & Billing

• Paid plans are billed monthly or annually through Stripe.
• Subscriptions do not auto-renew. When your billing period ends, your plan expires and your account moves to the Free tier.
• You may renew your subscription at any time from your dashboard.
• Prices may change with 30 days' notice. Active subscribers keep their current price until the end of their billing period.

4. Refund Policy

• 7-day money-back guarantee on your first payment, no questions asked.
• Annual plans cancelled within 30 days receive a prorated refund for the remaining months.
• To request a refund, email support@upbot.gg. We respond within 48 hours.

5. Free Tier

The Free plan provides limited access to Upbot's features at no cost. We reserve the right to modify the Free plan with 30 days' notice. Free plan users will be given the opportunity to upgrade or export their data before any changes take effect.

6. Data After Cancellation

Your service configurations are retained after cancellation so you can return and resume where you left off. Services above Free tier limits are paused but not deleted unless you request it. Status history follows the retention schedule described in our Privacy Policy.

7. Acceptable Use

You agree not to:

• Abuse, overload, or interfere with Upbot's infrastructure or other users' experience.
• Use Upbot to attack, harass, or disrupt the services you are monitoring.
• Resell, sublicense, or redistribute access to Upbot without written permission.
• Monitor services you do not have authorization to access.
• Circumvent rate limits, feature restrictions, or other safeguards.

8. Service Availability

Upbot is provided on a best-effort basis. We aim for high availability but do not guarantee uninterrupted service. No formal SLA is provided for Free, Pro, or Server plans. Scheduled maintenance will be communicated in advance via Discord or email.

9. Dispute Resolution

We do not require mandatory arbitration. If you have a dispute with us, you may pursue it in small claims court or through any legal remedy available in your jurisdiction.

10. Limitation of Liability

Upbot is provided "as is" and "as available" without warranties of any kind, express or implied. To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill arising from your use of the service. Our total liability is limited to the amount you paid us in the 12 months preceding the claim.

11. Termination

• We may suspend or terminate your account for violation of these Terms, abuse of the service, or non-payment.
• You may cancel your account at any time. Your configuration data is retained unless you request deletion.
• We will make reasonable efforts to notify you before termination, except in cases of severe abuse.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you via Discord, email, or a notice on our website at least 14 days before changes take effect. Continued use of Upbot after changes take effect constitutes acceptance. If you disagree with any changes, you may cancel your account and request data deletion.
